Arbitration Pending on Hockey Exclusivity Clause at Mile One

There has been much speculation recently about whether or not there will be a hockey franchise at Mile One for the 2018-19 season.
 
St. John’s Sports and Entertainment, Ltd. (SJSE) has a contract with Atlantic Sports Enterprises, Ltd. (ASE) to offer basketball at Mile One; the City of St. John’s has been pleased with the quality of entertainment and the community response to basketball to date.  
 
Within the contract for basketball there is an exclusive right for ASE to bring hockey to the facility until March 31, 2019. The contract provides for the exclusivity period to come to an end earlier under certain circumstances. A disagreement has arisen as to whether or not this exclusivity period has come to an end.
 
Atlantic Sports Enterprises, Ltd. has indicated that they intend to go to binding arbitration on the matter. Therefore, the City of St. John’s and SJSE will not negotiate nor enter into any agreement with any proponent until the decision of the arbitrator is made. To do so could negatively impact on this or any future partnerships.
